1. About these terms

These terms govern the use of Provador de Joias, a technology of TIEX TECNOLOGIA E INOVACAO LTDA, registered in Brazil under CNPJ 52.667.724/0001-97, based in Guaporé, Rio Grande do Sul (“Tiex”). By using the website, the virtual try-on, the dashboard or our apps on e-commerce platforms, you agree to these terms and to the Privacy Policy.

2. The service

Provador de Joias lets shoppers of jewelry and eyewear stores see a piece applied to their own photo, in an image generated by artificial intelligence from the store’s catalogue photo. The merchant can also use the studio to create product photos on a model.

The generated image is an illustrative simulation. Size, colour, shine and how the piece sits may differ from the real piece, from the lighting and from the photo sent. What counts for the purchase is the information on the store’s product page.

3. Use of the try-on by shoppers

By using the “Try it on” button, you agree to:

• send only photos of yourself or of people who have authorised their use;
• not send photos of minors without their guardian’s authorisation;
• not send offensive, intimate or illegal content, or content that infringes the rights of others;
• not use the service in an automated way or in a way that overloads it.

We may block access that breaks these rules.

4. The merchant account

• The account belongs to the registered company. Whoever creates it states they have authority to represent it.
• The merchant is responsible for keeping passwords secret and for the access granted to their team.
• The merchant warrants they hold the rights to the product photos they publish and send to the service.
• A merchant offering the try-on on their own site is the controller of their shoppers’ data and must keep them informed — for example by pointing to our Privacy Policy from the store’s own policy.

5. Plans, quotas and payment

• Access is by monthly subscription, with a quota of try-ons and photos per month according to the plan. Subscriptions taken on our site are processed by Stripe; subscriptions taken through the Shopify App Store are billed by Shopify together with the merchant’s own invoice.
• There is no lock-in: the merchant can cancel at any time, and access runs to the end of the period already paid for.
• Unused quota does not roll over to the next month. Once the quota is reached, new try-ons are unavailable until renewal or a change of plan.
• Non-payment may suspend the service until it is settled.
• Commercial terms agreed in a specific proposal prevail over this section.

6. Apps on e-commerce platforms

By installing our app on a platform (such as Shopify or Nuvemshop), the merchant authorises Tiex to show the “Try it on” button on the storefront. Uninstalling from the platform’s own admin removes the button and deletes the access granted. Billing for the subscription remains governed by section 5.

7. Intellectual property

The brand, the software, the widget and the website belong to Tiex. Product photos remain the merchant’s, and the photo sent by a shopper remains that shopper’s. The merchant may use the generated images in their own store and sales channels, respecting the image rights of the people portrayed.

8. Availability and liability

We work to keep the service available, but it depends on the internet, on artificial intelligence providers and on the e-commerce platforms, and it may be interrupted. Tiex is not liable for purchase decisions made on the basis of the simulation, nor for content sent by users in breach of these terms.

9. Changes and jurisdiction

We may update these terms; merchants are told by email about relevant changes. Brazilian law applies, and the courts of Guaporé, Rio Grande do Sul, are elected, without prejudice to a consumer’s right to use the courts of their own domicile.
